The Preferential Interest Law (Ley de Interes Preferencial, or PIL) is one of Panama's most powerful financial mechanisms to enable homeownership. Since its creation in 1985 (Law 3 and successive reforms), it has allowed hundreds of thousands of families to access a mortgage at rates significantly lower than market.
In 2026, important adjustments took effect that change who qualifies, how much is subsidized, and for how long. If you are evaluating buying your first home — or a home that fits the new brackets — this guide shows you exactly what changed.
What the Preferential Interest Law Is (Summary)
The State subsidizes the difference between the market rate and a lower preferential rate during the first years of the mortgage loan. The bank receives the full market rate (does not lose money), and the State pays the bank the difference on behalf of the customer.
In one sentence: you pay less interest during the first years, the bank charges the same, and the State pays the difference.
The New 2026 Brackets
Starting in 2026, the brackets were adjusted to respond to market price increases (new apartment prices rose approximately 12-18% since 2022). The caps are now:
| Bracket | Property value | Subsidy term | Approximate rate reduction |
|---|---|---|---|
| Low bracket | up to $120,000 | 10 years | up to 4.5 points |
| Mid bracket | $120,001 - $180,000 | 8 years | up to 3 points |
| High bracket | $180,001 - $300,000 | 5 years | up to 2 points |
Exact points depend on the market rate at signing. The subsidy covers the difference down to a minimum agreed rate (typically 4.00-4.50%).
Who Qualifies in 2026
For low and mid brackets:
- Be Panamanian or permanent resident with at least 5 years of residency
- The home must be the buyer's first property (no other property previously registered)
- Exclusively residential use (no commercial Airbnb, no office, no commercial space)
- The registered value (not just the sale price) must be within the bracket
- The loan must be a formal mortgage with a bank authorized by the SBP
For the high bracket ($180K-$300K), additional requirements on family income are added.
Key Changes vs. Previous Versions
If you reviewed this regime 2-3 years ago, note these 2026 adjustments:
- General cap raised from $240K to $300K — now covers properties that were previously excluded.
- The $120K-$180K bracket became independent with its own term (8 years) and points.
- Foreign residents with 5+ years now qualify without the additional Panamanian-spouse requirement.
- The procedure was digitized: the application goes through the MEF portal along with loan registration — reduced from 45-60 days to 15-25 business days.
- Caps will be reviewed every 2 years tied to a real estate price index (previously fixed by law).
How Much You Can Save (Examples)
These are rounded examples. Exact amounts depend on the market rate at signing and the loan's full term.
$150,000 apartment, 30-year loan, 7.5% market rate:
- Payment without Preferential Interest: ~$1,049/month
- Payment WITH PI (rate reduced to 4.50% for 8 years): ~$760/month
- Monthly savings in the first 8 years: ~$289
- Accumulated savings 8 years: ~$27,700
$220,000 apartment, 30-year loan, 7.5% rate:
- Payment without PI: ~$1,538/month
- Payment WITH PI (rate reduced to 5.50% for 5 years): ~$1,249/month
- Monthly savings in the first 5 years: ~$289
- Accumulated savings 5 years: ~$17,300
How to Apply (Step by Step)
- Bank pre-approval: the bank pre-approves the amount without yet deciding whether PI will apply.
- Purchase promise: you sign with the developer/seller. Make sure the contract mentions the property "qualifies for the Preferential Interest Law" if it's within the bracket.
- MEF application: the bank initiates the application before the Ministry of Economy and Finance. You provide the documentation: ID, income certification, sworn first-home declaration, purchase promise.
- Approval and disbursement: once the subsidy is approved, the bank closes the loan at the reduced rate. Notary signing + Public Registry inscription.
- Follow-up: every 12 months the bank validates subsidy continuity (you still live there, haven't rented commercially, etc.).
Common Mistakes That Can Disqualify You
- Immediate rental: if you rent the property before year 3, you lose the benefit (some banks require returning the subsidized portion).
- Value over the cap due to remodeling: if you renovated and the appraisal rises above the bracket, you lose the benefit going forward.
- Hidden second home: if the MEF detects you had another property even under a direct family member as a "front," there is a sanction.
- Commercial use: turning it into a full-time Airbnb voids the subsidy (occasional Airbnb when you live there is more ambiguous, consult specific case).
Is It Worth It vs. Waiting?
In the 2026 context, with market rates between 7.0% and 8.5%, the Preferential Interest Law is the only mechanism that substantially lowers your real payment without requiring a massive down payment. Compared to mortgages without subsidy, we're talking $250-$400 less per month during the first 5-10 years.
If your case fits any of the brackets, the answer is almost always yes. The real variable is whether the apartment itself works for you as an investment and location — not whether to apply for the subsidy or not. The subsidy always benefits you when you qualify.
Next Steps
- Verify whether your budget range falls into any of the brackets.
- Request pre-approval from 2-3 banks and explicitly ask about the Preferential Interest Law.
- Check whether the property you are interested in is within the registered value cap (not just sale price).
- Consult a real estate attorney if you are a foreign resident to confirm your eligibility.
